JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-12-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.
The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 30.06.2016 passed in Cr. Misc. No. 21009 of 2016 on the ground that the petitioner is suffering in custody since 08.12.2015, the trial has not been concluded within the stipulated period and the petitioner was given liberty to renew his prayer for bail.
The learned A.P.P. submits that earlier considering criminal antecedent of the petitioner his prayer for bail was rejected.
In the facts and circumstances as stated above, now the petitioner is directed to be released on bail on furnishing bail
Patna High Court Cr.Misc. No.52610 of 2016 (2) dt.07-12-2016 2/2 bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Sitamarhi in Bairgina P.S. Case No. 230 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
