Mr.Ganesh Prasad Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE P. B. BAJANTHRI ORAL ORDER 09-12-2022 This matter is heard through video conferencing. In the instant regular bail application, petitioner has sought for regular bail.

With reference to the alleged offence under Section 392 of Indian Penal Code in P.S. case No. 328 of 2021 dated 26.04.2021 in Raniganj police station.

Perusal of the records it is evident that petitioner is habitual offender in particularly under Section 392 of Indian Penal Code and he is involved in more than one case other than the present case.

Learned counsel for the petitioner vehemently contended that his name was cropped up in the F.I.R on the statement made by the co-accused. Therefore, he is entitled for

Patna High Court CR. MISC. No.52285 of 2022(2) dt.09-12-2022 2/2 regular bail. Having regard to the antecedents of the petitioner till filing of charge-sheet, he may not be entitled to bail and that apart he is likely to commit identical crime. The petitioner has already invoke remedy for regular bail before the learned 2nd Addl. Sessions Judge, Araria in which he has suffered order.

In the light of these facts and circumstances present bail application stands rejected.
