Petitioner prays for bail in connection with K. Hat (Madhubani) P.S.Case No. 418 of 2018 registered for the offences punishable under Sections 363, 376, 377, 406, 420, 504 and 34 of the Indian Penal Code.
Allegation as per FIR is of kidnapping of the informant by son of the petitioner and of forcibly marrying her and also snapping some obscene photographs.
Submission of learned counsel for the petitioner is that there was love affair between the son of petitioner and the informant and as the marriage was intercaste her parents were unhappy and lodged this false and concocted case. Further submission is that petitioner is in custody since 22.7.2018 and
Patna High Court Cr.Misc. No.60434 of 2018 (2) dt.06-10-2018 2/2 mother, brother of the boy and other accused persons have been granted bail by a co-ordinate Bench of this Court vide order dated 26.9.2018 passed in Cr.Misc.No. 50832 of 2018. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with K. Hat (Mdhubani) P.S.Case No. 418 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
