JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was caught on the spot while he made attempt to commit loot and firearm was recovered from his conscious possession. Para-3 of the petition goes to show that prior to institution of the present case, petitioner had been made accused in Sonbarsa P.S.Case No. 127 of 2013 registered under section 394 of the Indian Penal Code.

Considering the previous conduct of the petitioner as well as facts and circumstances, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sonbarsa P.S.Case No. 96 of 2016, pending in the court of Chief Judicial Magistrate, Sitamarhi, stands rejected.

Patna High Court Cr.Misc. No.42562 of 2016 (3) dt.24-11-2016 2/2 However, petitioner may renew his prayer for bail after completion of one year in custody, if his trial is not concluded within the above stated period.
