06-10-2016 Heard Smt. Babita Kumari, learned counsel for the petitioner and Smt. Madhuri Lata, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 19-07-2016 in Sono P.S. Case No. 100 of 2016 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 47(A)(F) of Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail.

By way of referring to statement made in paragraph - 3 of the petition, it was submitted by learned counsel for the petitioner that petitioner is having clean antecedent and on false allegation of recovery of huge quantity of foreign liquor, the petitioner has been made accused.

Patna High Court Cr.Misc. No.40890 of 2016 (2) dt.06-10-2016 2/2 Learned Addl. Public Prosecutor has opposed the prayer. It was submitted by learned State counsel that huge quantity of foreign liquor was recovered from a vehicle and petitioner has claimed to be driver-cum-owner of the vehicle. Keeping in view the nature of accusation, period of custody and clean antecedent of the petitioner, let the petitioner namely Rajnish Kumar be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - I, Jamui in connection with Sono P.S. Case No. 100 of 2016.
