02. 25.10.2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 47 of the Excise Act.
It is contended on behalf of the petitioner that the petitioner was allegedly apprehended along with a half empty bottle country-made liquor, however, allegedly from his "Dalan" 55 litres of country-made liquor were recovered. It is further contended that the petitioner is in custody since 02.09.2016 and he is having clean antecedent.
Having regard to the facts and circumstances of the case, the petitioner, namely, Bijay Prakash Singh @ Bigan
Patna High Court Cr.Misc. No.45685 of 2016 (2) dt.25-10-2016 Singh is directed to be released on bail on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IX, Saran at Chapra in connection with Taraiya P.S. Case No. 202 of 2016 subject to the condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
