The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on a raid being conducted 493.56 litres of IMFL was recovered from the house of coaccused Ranjan Jha @ Sanjeev Kumar and both the said accused and the petitioner who made an attempt to escape were caught.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He was arrested under a misunderstanding. No incriminating article has been recovered from his possession. The alleged place of recovery is the house of the co-accused Ranjan Jha. The

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner not having any criminal antecedent and having remained in custody for 8 months, the petitioner is directed to be enlarged on bail in connection with Khodawandpur P.S. Case no. 201 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II - cum - Special Judge, Excise, Act, Begusarai.
