JUSTICE MADHURESH PRASAD ORAL ORDER 13-08-2020 Since as of now the Courts have not resumed normal physical hearing, the matter has been listed today for consideration through video conferencing.

The learned counsels are appearing and making submissions from their residence. The Court Master and Secretary are also part of this virtual Court proceedings from their homes, all with the aid of audio visual technology. Heard learned counsel for the petitioner and the learned Counsel for the respondents.

The Court has perused the last two orders dated 16.10.2019 and 13.11.2019 passed in the instant proceedings.

Patna High Court CWJC No.16127 of 2019(7) dt.13-08-2020 2/2 The petitioner has been paid subsistence allowance to the tune of Rs.2,36,024/-, which has been recorded in the earlier order dated 16.10.2019. For payment of balance amount of retiral dues, i.e., 90% gratuity and group insurance amount, the matter was adjourned. Subsequently, on 13.11.2019 outstanding retiral dues quantified at Rs.9,00,000/- (nine lacs) was paid by a cheque to the petitioner, which has been recorded in the order dated 13.11.2019.

The counter affidavit of the Zila Parishad records that there is no further dues admissible to the petitioner under the heading "retiral dues".

Petitioner's counsel, however, submits that some other dues would also be payable to the petitioner, for which he may be granted liberty to approach the authorities. The petitioner would be at liberty to approach the authorities for any amount that he considers due, specifying the head under which the dues are claimed.

The writ petition is disposed of with the aforesaid liberty.
