The petitioner seeks regular bail in connection with Mehandia P.S. Case No.54 of 2017 registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.
The case has been lodged by the informant, who is Block Development Officer, Kaler, stating that 37 beneficiaries of PMRY Scheme did not receive the entire amount Rs.55,000/- which was transferred in the account of each beneficiary in which they only received Rs.30,000/-.
It has been submitted that this petitioner is not named in the F.I.R. The petitioner is Assistant of Rural Housing of
Patna High Court Cr.Misc. No.59124 of 2018 (2) dt.08-10-2018 2/2 Jaipur, Teri Panchayat having no role at all in disbursement of amount. The allegation of beneficiary is against co-accused Deepak Sharma who is the In-charge of Customer Service Centre, Mehandia. The said Deepak Sharma is only named accused in the F.I.R, who has been allowed bail by one of the coordinate bench of this court in Cr.Misc.No.50686 of 2017. The allegation against this petitioner is omnibus and he is in custody since 26.05.2018 having clean antecedent.
The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Mehandia P.S.
