JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 420, 467, 468 and 471/34 of the I.P.C. Allegation is that the accused persons including the petitioner grabbed the land of the complainant by committing forgery.

A report was called for from the trial court regarding the stage of the case. The same is at Flag 'X'. It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.11.2015 i.e. for last about one year and the charge sheet has been submitted in the present case.

Patna High Court Cr.Misc. No.40179 of 2016 (3) dt.24-11-2016 The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is a lady. She has executed a sale deed in favour of co-accused Dipak Kumar Mishra exceeding her share in the property. Relating to the said dispute a suit is pending in the court. The matter relates to civil dispute.

On behalf of the State, it is submitted that the petitioner is named in the complaint case.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra in connection with Complaint Case No.569 of 2012 corresponding to Trial No.1398 of 2016.
