Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Mokama P.S. Case No. 108 of 2019 corresponding to Sessions Trial No. 187 of 2020, registered for the offence punishable under Sections 363, 365 of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have abducted the sister of informant with intent to marry. It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence. The victim girl was recovered from the house of one Ranjeet Kumar.

Patna High Court CR. MISC. No.9664 of 2021(2) dt.22-07-2021 2/2 Petitioner is in custody since 01.07.2020.

Learned APP however, vehemently opposed the prayer for bail and submitted that victim girl in her statement under Section 164 Cr.P.C has clearly stated that petitioner took her away and forcibly tried to marry with her. Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
