Petitioner, Kishori Yadav, is in custody since 30.06.2016 in Palanwa P.S. Case No. 23 of 2016 registered under Sections 366(A), 120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submitted that in fact, there was love affairs between Jeetlal Yadav and the daughter of the informant and in fact they had also married and are now living their conjugal life. So far allegation against the petitioner is that he had informed the informant that his daughter had went away with Jeetlal Yadav and another Guddu Kumar on motorcycle. Except this allegation against this petitioner, there is nothing but the compromise application has been annexed with this bail application as annexure-2. From perusal of the same, it appears that Jeetlal Yadav and the daughter of the informant have already married.

Considering the facts and circumstances of the case, I direct the petitioner, above named, be released on bail on furnishing bail bond of Rs. 5,000/- (Five Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxaul at Motihari in connection with Palanwa P.S. Case No. 23 of 2016.
