The present case has been taken out of turn based on the mentioning made by Shri Sanju Singh, learned counsel for the petitioner on the ground that the mother of the petitioner died on 12.03.2022 and the final function is to be held on 23.03.2022.
The petitioner seeks bail in connection with Sono P.S. Case No. 30 of 2021 instituted for the offences under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 14.07.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the

No.61772 of 2021(2) dt.21-03-2022 2/3 informant alleges that he along with his friend Prince Kumar were returning after collecting the money and when both reached near Lakha Kiary Iron Bridge then two motorcycle borne criminals intercepted them and looted the informant and fled from the place of occurrence.
Learned counsel for the petitioner submits that the F.I.R. is against unknown and this petitioner came to be implicated based on the S.I.M. which he got from his friend which he was using in his wife's mobile. Learned counsel submits that had the petitioner been knowing that the S.I.M. is a looted article then definitely he would not have been using it in his wife's mobile. Learned counsel further submits that petitioner is a person with clean antecedent and even assuming what has been alleged is true, without admitting, then it is his first offence.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
