JUSTICE BIRENDRA KUMAR ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 448/307/120B/149 of the Indian Penal Code, Section 27 of the Arms Act and Section 3⁄4 of the Explosive Substances Act.

According to F.I.R. some unknown person fired at the informant, however, no injury was caused to the informant rather one of the miscreants sustained injury. Allegation is that under conspiracy of the named person the occurrence took place. Submission of the petitioner is that name of the petitioner had transpired in the confessional statement of Mahesh Sah. Co-accused Munna Sah has already been allowed bail in Cr.

Patna High Court Cr.Misc. No.48119 of 2016 (2) dt.20-12-2016 2/2 Misc. No.15721 of 2016 on 05.09.2016.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui/Successor Court, in connection with Jamui P.S. Case No.237 of 2015.
