The application is for grant of bail for the offence under Sections 393, 412, 413 and 414 of the Indian Penal Code and 25 (1-B)A/26/35 of the Arms Act.

It has been submitted on behalf of the petitioner that only on the basis of suspicion, he has been arrested. One country-made Pistol has been recovered from the possession of the co-accused, Puja Devi and one Motorcycle of black colour has been recovered from the possession of Sadhu Paswan. Patna High Court Cr.Misc. No.55210 of 2016 (2) dt.09-01-2017 granted bail by this Hon'ble Court, vide order dated 16.12.2016 passed in Cr. Misc. No.53523 of 2016 and the petitioner is in custody for about three months.

Heard learned A.P.P. also.

Having heard both sides. In view of the fact that nothing has been recovered from the possession of the petitioner and he has no criminal antecedent as well as the fact that he is in custody for about three months, let petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Rajeev Kumar Bharti, J.M. Ist Class, Patna City in connection with Bypass P.S.Case No.113 of 2016.
