JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 07-09-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceeding. The petitioner seeks bail in connection with Pupari P.S. Case No.262/2020 registered for the offence punishable under Section 414 of the IPC and 8/20(b)/22b N.D.P.S. Act. Allegation against the petitioner is that he along with on Ramdeo Yadav were apprehended by the police and recovered two packets of Ganja weighing 1.50 kg.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He has been falsely implicated in this case with false allegation. The petitioner was only carrier of the packets containing 750 g.m Ganja which came through First Flight courier belong to his known person and he was quite

The Packets containing 750 gm each recovered from two persons, one was driving the bike and another was pillion rider. Therefore, recovered quantity is less than the small quantity according to each accused. Petitioner was not found indulged in action of selling or purchasing of the article. The petitioner has no criminal antecedent and has been languishing in custody since 06.09.2020.

Learned APP for the State opposed the prayer for bail. Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below, where the case is pending/Successor court in connection with Pupari P.S. Case No.262/2020.
