The petitioner seeks bail in Parbatta P.S. Case No. 66/2015 registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

The informant alleged that she had gone to attend the Sradh cerermony of her father, but when she came back she found the lock of her house has been broken and articles were stolen. The informant suspected that the petitioner Shambhu Kunwar @ Shempu Kumar and others namely Nand Kishore Kunwar, Sanjiv Kumar @ Mantun Kunwar and Janardhan Kunwar might have committed theft in her house.

Learned counsel for the petitioner submits that the petitioner happens to be step brother of the husband of the

Patna High Court Cr.Misc. No.1310 of 2017 (2) dt.16-01-2017 2/2 informant. Save and except suspicion there is no material against the petitioner. Nothing has been recovered from the possession of the petitioner.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Khagaria in Parbatta P.S.
