Having regard to the nature of allegation for offence under Sections 302 and 328/34 of the Indian Penal Code and the involvement of the petitioner is surfaced on the last seen, this Court, keeping in view the material in the case diary that both the petitioner and the co-accused Shiv Narayan Ram had allegedly taken the deceased in their company whereafter the dead body was ultimately found, would not find the petitioner to be entitled for privilege of anticipatory bail. That being so, the prayer for anticipatory bail of the petitioner is hereby rejected, but then, if the petitioner would surrender, the court below must keeping in view that the criminal case is of the year 2011, his prayer for regular bail shall be considered on its own merit without being prejudiced by anything said in this order.
