The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.

As per the prosecution case, amount of Rs. 31,000/- was illegally transferred from the bank account of informant to the bank account of petitioner.

It is submitted that in fact, petitioner had no knowledge about the illegal transfer of money to her bank account from the bank account of informant. After two years of the alleged occurrence, the concerned Branch Manager informed her regarding said illegal transfer. On information by the Branch Manager of the bank when the petitioner went to the

Patna High Court CR. MISC. No.52633 of 2022(2) dt.20-12-2022 2/2 bank, the Branch Manager without her request took her ATM card and changed the same. Petitioner requested the Branch Manager to get her passbook printed, but he refused to do so which shows the Branch Manager is liable for the illegal transfer of money in her account. Petitioner has not withdrawn any money from the account in question. She is a lady and claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of her arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Saran in connection with Bheldi P.S. Case No. 299 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
