Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365, 372 and 120(B)/34 of the Indian Penal Code.

Co-accused Kanak Lal Malakar is cousin Phufa of the informant. He along with Ravinder Kumar Thakur and others came to the house of the informant thereafter Ravinder took the two children of the informant Gyatri Kumari and Suraj Kumar to the market on the pretext of purchasing clothes for them. Thereafter the children were missing. The statement of Gyatri Kumari and Suraj Kumar the victim-girl and the boy respectively recorded under Section 164 Cr.P.C. has supported the allegation against co-accused Ravinder Kumar Thakur to have kidnapped

Patna High Court Cr.Misc. No.49564 of 2016 (2) dt.22-12-2016 2/2 them and taken to Bhagalpur and thereafter at Badayu (Uttar Pradesh).

Submission of the petitioner is that there is no allegation against the petitioner and co-accused Umesh Malakar has already been allowed bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 40624 of 2016.

Considering the aforesaid facts, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-cum-Sessions Judge, Katihar/Successor Court in connection with S.T. No. 211 of 2016 arising out of Barari P.S. Case No. 166 of 2016. (Birendra Kumar, J) kundan/- U T
