The petitioner is apprehending his arrest in connection with Katihar Muffassil P.S. Case No. 152 of 2016 for the offences instituted under Sections 366(A)/34 of the Indian Penal Code. The allegation against the petitioner is of abducting the minor daughter of the informant while she was returning from coaching centre.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. He has falsely been implicated in the present case. The victim girl has been examined under Section 164 of the Cr.P.C., where she has not supported the allegations made in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Katihar Muffassil P.S. Case No. 152 of 2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri A.K. Sharma, J.M.1st Class, Katihar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
