The petitioner apprehends his arrest in connection with Kotwali P.S. Case No. 143 of 2012 registered for the offences punishable under Sections 419, 420 of the Indian Penal Code and under Section 18(4), 18(a)(vi) and 27(b)(ii) of the Drugs and Cosmetics Act.

Case diary in the present case has also been received. A categorical statement has been submitted by learned counsel for

Patna High Court Cr.Misc. No.7711 of 2015 (3) dt.20-05-2015 2/2 the petitioner that petitioner is the transporter and has nothing to do with the alleged seizures of the truck. However, after careful perusal of the case-diary, it is not appear that he is transporter in fact, a false statement has been made in the affidavit. It is Ravindra Kuamr Singh who is alleged transporter of Om Sai Express Carrier, Murarpur, B.N. Jha Road, Gaya. Considering the false statement made in the affidavit, I am not inclined to let the petitioner be enlarged on bail. Hence, anticipatory bail of the petitioner is hereby, rejected.
