The petitioner apprehends his arrest in Chanan P.S. Case No.137 of 2017, registered under Sections 30(a), 32(1) and 38(1) (2) of the Bihar Prohibition and Excise Act.

The informant got secret information that a person was carrying liquor on a black colour motorcycle. The motorcycle was found parked by the side of the road and 5 litres of country made liquor was recovered from the dickey of the motorcycle. The motorcyclist was not present there.

It transpires that it was petitioner who is the owner of the motorcycle and he was driving the motorcycle but after seeing the police, the petitioner fled away.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Jha, J) S.KUMAR/- U T
