JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Siswan (Chainpur O.P.) P.S. Case No. 120 of 2016 registered for the offence punishable under Section 366 (A) of the Indian Penal Code.

Allegation against the petitioner is that he abducted minor daughter of the informant but during investigation the said girl appeared and her statement was recorded under Section 164 Cr.P.C. wherein she has stated her age 18 years and the learned Magistrate also assessed her age 18 years and she has denied regarding her kidnapping rather she has stated that she out of her own sweet will and consent performed marriage with the petitioner and she is living with him as wife and husband. No.55687 of 2016 (2) dt.10-01-2017 statement of the victim recorded under Section 164 Cr.P.C., the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class/concerned Court, Siwan in connection with Siswan (Chainpur O.P.) P.S. Case No. 120 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
