Petitioner, who is in custody, seeks bail in connection with Chainpur P.S. Case No. 216 of 2018 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Informant who is the police officer has stated that when he was on patrolling duty with other police personnel one indigo car was stopped in which 5 accused persons were sitting and on seeing police party, they tried to flee away, however, two were apprehended and 230 pieces of bottles containing 180 ml. each from the said vehicle was recovered.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case.

Patna High Court Cr.Misc. No.61093 of 2018(2) dt.05-10-2018 2/2 Nothing was recovered from his possession. He has no concern with the vehicle. He has no criminal antecedent and he is in custody since 12.08.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Kaimur at Bhabua in connection with in Chainpur P.S. Case No. 216 of 2018.
