Petitioner is languishing in custody in connection with Barauni Rail P.S. Case No. 29 of 2016 for the offences punishable under Section 379 of the Indian Penal Code. Some unknown person committed theft of purse of the informant from running train.

Submission is that the petitioner is in custody since 18.08.2016. No Test Identification Parade has been done and his name has been deliberately dragged in this case only on the basis of the criminal record of the petitioner with the police. Considering the aforesaid material and period already undergone, let petitioner, above named, be enlarged on

Patna High Court Cr.Misc. No.52458 of 2016 (2) dt.07-12-2016 2/2 bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Begusarai, in connection with Barauni Rail P.S. Case No.29 of 2016 subject to the condition that both the bailors shall be local people having immovable property within the jurisdiction of the Court.
