JUSTICE SANJAY PRIYA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Manjhagarh P.S. Case No. 192 of 2018 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 302 and 504 of the Indian Penal Code. Counsel for the petitioner submits that petitioner is merely alleged to be member of unlawful assembly. There is no overt act against the petitioner. Petitioner is 70 years old. In the written report there is specific allegation that Awadh Yadav has assaulted the father of the informant with Bhala and Nanhey Yadav assaulted father of the informant with Farsa on his head.
Petitioner is in custody since 7.7.2018.
Patna High Court Cr.Misc. No.59868 of 2018 (2) dt.06-10-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Manjhagarh P.S. Case No. 192 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
