JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-12-2016 Heard learned counsel for the petitioner as well as learned A.P.P for the State.

The petitioner seeks bail in connection with Bahadurganj P.S. Case No. 196 of 2016 registered for the offences punishable under Section 47 of the Bihar Excise (Amendment) Act.

Prosecution case is that on search by the police personnel, 22 bottles containing 180 ML 8 PM and 15 bottles each containing 180 ML Imperial Blue wine were recovered from the bag of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has been implicated falsely in the present case and no incriminating articles as alleged have been recovered from the conscious

Patna High Court Cr.Misc. No.49834 of 2016 (2) dt.13-12-2016 2/2 possession of the petitioner. The petitioner is languishing in custody since 17.09.2016.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P.S. Case No. 196 of 2016.
