JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 25(1-B)a, 26 and 35 of the Indian Penal Code.
The police chased certain fleeing persons when one Anjar Alam was apprehended from whom a country made pistol was recovered who suggested the name of this petitioner as his accomplice.
It is submitted by learned counsel for the petitioner that there is nothing on record to suggest the complicity of the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or
Patna High Court Cr.Misc. No.24425 of 2015 (2) dt.29-06-2015 2/2 surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Kishanganj in connection with Kochadhaman P.S. Case No. 02 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. Learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutives occasions or gets involved in some serious nature of offence.
