Heard learned counsel for the petitioners and the State.

The petitioners seek bail in Wazirganj P.S. Case No. 147 of 2019, instituted for the offence under Section (s) 341, 323, 307 and 379 of the Indian Penal Code. Counsel for the petitioners submits that there is case and counter case between the parties. Petitioner No. 1 has lodged First Information Report on the same day of occurrence vide Wazirganj P.S. Case No. 148 of 2019 against the informant and others for the offence under Sections 341, 323

Patna High Court CR. MISC. No.51187 of 2019(2) dt.21-08-2019 2/2 and 379/34 of the Indian Penal Code.

In the instant case there is allegation against the petitioners that they assaulted elder brother of the informant namely, Ram Lakhan Yadav.

The injury report of elder brother of the informant has been enclosed as Annexure-2 wherein the Doctor has found simple injury on his person. No obvious skull fracture has been found.

Counsel for the informant has appeared and opposed the prayer for bail Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Gaya, in connection with Wazirganj P.S. Case No. 147 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioners.
