ANJANA MISHRA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 23.04.2018 in connection with Aurangabad Town P.S. Case No.97 of 2018 registered for the offence under Sections 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 333, 353, 153A, 295A and 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation is based only on suspicion and at best, the petitioner can be treated to be a member of the crowd. It is further submitted that the petitioner has got one other antecedent, in which he has been remanded after he was taken

Patna High Court Cr.Misc. No.59469 of 2018 (2) dt.28-09-2018 2/2 into custody in connection with the present case. Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Town P.S.
