The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. As per prosecution case, while the informant, who is working on the post of relationship officer in Micro Finance at Supaul, went by his motorcycle to collect the money in the way three boys riding on a motorcycle stopped his motorcycle and on point of pistol snatched the cash from him. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence. He has falsely been implicated in the present case. Patna High Court CR. MISC. No.55577 of 2023(4) dt.02-12-2023 2/2 confessional statement of co-accused Chandra Kishore Yadav, which has no evidentiary value in the eye of law. He has no concern with alleged occurrence. No any incriminating or looted article has been recovered from his conscious possession. The other co-accused Arvind Kumar has already been granted bail by this Bench vide order dated 14.07.2023 passed in Cr. Misc. No. 41479 of 2023. Moreover, the petitioner is languishing in judicial custody since 28.02.2023.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Pipra P.S. Case No. 52 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul.
