Heard learned counsel for the petitioner and the State. The petitioner prays for grant of bail in N.D.P.S. Case no. 18 of 2019 arising out of NCB Case no. 13/2019 registered for the offence punishable under sections 8, 2, 20, 25, 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. Earlier prayer for bail of the petitioner was rejected on 22.06.2020. On the last occasion, report was called for regarding stage of the trial. Report of the trial court has been received vide letter dated 08.06.2021 which reveals that out of five prosecution witnesses, three witnesses have already been examined and only two witnesses are to be examined.
Patna High Court CR. MISC. No.9808 of 2021(3) dt.19-07-2021 2/2 Considering the nature of the allegation and the fact that commercial quantity of Narcotic substance has been recovered from the vehicle in which petitioner was sitting, bail application of the petitioner is rejected.
As the petitioner is in jail custody since 26.05.2019, trial court is directed to conclude the trial of the petitioner as early as possible.
