The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272 and 273/34 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act.
Prosecution case is that allegedly petitioner with the help of 50 to 60 Naxals kidnapped three persons, namely, Ravindra Rajak, Ganesh Rajak and Rajendra Rajak for the purpose of extortion. Out of these three persons, one of them, namely, Ravindra Rajak was released by the Naxals. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has not been apprehended at

He further submits that petitioner's name was transpired during investigation merely on the basis of suspicion of one Ranjit Koda who was arrested in another case bearing Kajra P.S. Case No.61 of 2018 in which Ranjit Koda confessed the guilt in present case including the petitioner. Learned APP appearing for the State has opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Lakhisarai in connection with Chanan P.S. Case No. 86 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
