The petitioner is apprehending his arrest in a case registered for the offences punishable under sections 379, 414/34 of the Indian Penal Code and section 27 of the Arms Act. Accusation against the petitioner is of committing theft of coal from the railway wagon which was being carried to N.T.P.C. Kahalgaon for use of thermal power station. Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and nothing has been recovered from his possession.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.33064 of 2015 (2) dt.11-08-2015 2/2 State that earlier similar accusation has also been leveled against the petitioner.

Let the learned court below consider the prayer for regular bail of the petitioner. If the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kahalgaon P.S. Case no. 463 of 2013 pending the court of Judicial Magistrate, Ist Class, Bhagalpur.

With the aforesaid observation, this application is disposed of.
