ANJANA MISHRA ORAL ORDER 20-05-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Pear P.S. Case No.114 of 2012 for allegedly having committed the offences under Sections 420 and 409 of the Indian Penal Code.

The petitioner is a Contractor, who constructed the R.C.C. culvert in Prakhand Bandara under Nunphara Panchayat from Lakshmi Narain Mandir to Sawaldiha under the Chief Minister Bridge Construction Scheme.

The allegation against the petitioner was that due to sub-standard construction, the said culvert has been damaged; leading to loss of public money.

Learned counsel for the petitioner submits that now as

Patna High Court Cr.Misc. No.8120 of 2015 (3) dt.20-05-2015 2/2 per the report, contained in Annexure 2, and the letter dated 2.9.2012, it appears that the petitioner has re-constructed the damaged portion on his own cost, for which he has not taken any penny. He thus prays that the petitioner may be extended the privilege of anticipatory bail.

Having perused the documents on record and considered the submissions advanced on behalf of the petitioner, I am satisfied that the petitioner can be extended the privilege of anticipatory bail.

Let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Pear P.S. Case No.114 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
