Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 379, 504, 506 of the Indian Penal Code and 27 and 30 of the Arms Act. The prosecution case in short is that the accused persons, variously armed, assaulted and fired at the informant due to which he sustained injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.6.2019. There is no

Patna High Court CR. MISC. No.51798 of 2019(2) dt.21-08-2019 2/2 allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The allegation is of using fire arms. As per the injury report, injury is said to have been caused by hard and blunt substance. The injury report does not support the allegation made in the F.I.R.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Sasaram in connection with Chenari P.S. Case No. 47/19.
