The petitioner, who is in custody, seeks bail in connection with Malyapur P.S. Case No. 52 of 2018 registered for the offence punishable under Sections 417, 420, 120(B) of the Indian Penal Code.
Informant has alleged in the FIR that one person is collecting rupees one thousand from each candidates who appeared for their medical test for selection of Constable in B.M.P. 11. It is further alleged that on such information A.S.I. of concerned P.S. reached there and petitioner was caught red handed collecting Rs. 57,000/- in currency note of 2000, 500, 200 and 100. 5000/- and petitioner told that one Sanjay Kumar
Patna High Court Cr.Misc. No.60297 of 2018(2) dt.11-10-2018 2/2 of Sadar Hospital had told him to collect the money. It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case by one Sanjay Kumar. It has been further submitted that petitioner's wife also appeared for medical test and petitioner accompanied him for medical test otherwise there was no occasion for him to be present at B.M.P. Centre, Jamui though he is resident of Bhojpur District. Petitioner has no criminal antecedent and he is in custody since 02.08.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Jamui, in connection with Malyapur P.S. Case No. 52 of 2018.
