The petitioner apprehends his arrest in Mirganj P.S. case No. 124 of 2019 registered under Section 272, 273 of the IPC and u/s 30(a) of the Bihar Prohibition & Excise Act. The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. The name of petitioner figured in the case as the petitioner is said to have fled away from the place of occurrence and recovery was made. It is submitted that recovery was made from an open field and not from the conscious possession of the petitioner but it appears that petitioner has got criminal antecedents and he is accused in Mirganj P.S. case No. 38 of 2018 and Mirganj PS case No. 353 of 2018.

Taking into consideration the facts aforesaid and the

Patna High Court CR. MISC. No.51255 of 2019(2) dt.17-08-2019 2/2 fact that petitioner has got criminal antecedent of similar nature, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same was rejected.
