====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 28-09-2018 Heard Sri Pradeep Kumar Sinha, learned counsel for the petitioners. None appeared on behalf of the State. Three petitioners, apprehending their arrest in Excise Case No. 124 of 2018 (Sadar Excise Circle P.R. No. 18/18-15) registered for offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail in the event of their arrest or surrender.
At the very outset, learned counsel for the petitioners has drawn my attention to statement made in paragraph-3 of the petition to show that petitioners are having clean antecedent. Besides this, learned counsel for the petitioners has also drawn my attention to the seizure list to show that nothing was
Patna High Court Cr.Misc. No.60289 of 2018(2) dt.28-09-2018 2/2 recovered either from conscious possession of petitioners or from their house, rather from the back of the house, recovery was shown.
Considering the nature of accusation, clean antecedent as well as the fact that nothing was recovered from conscious possession of petitioners, in the event of arrest or surrender within a period of six weeks from today, let aforesaid three petitioners namely (i)Satrudhan Paswan @ Shatrudhan Paswan, (ii) Birendra Paswan and (iii) Binod Paswan be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Excise Case No. 124 of 2018 (Sadar Excise Circle P.R. No. 18/ 18-15), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
