Petitioner, who is in custody, seeks bail in connection with Turkaulia P.S. Case No. 116 of 2016 registered for the offences punishable under Sections 304 (B), 201 and 120(B) of the Indian Penal Code.
Allegation against petitioner and other co-accused is of killing and disposing the dead body of the daughter of informant due to non-fulfillment of demand of dowry. It has been submitted on behalf of the petitioner that she is innocent and has committed on offence. She has been falsely implicated in this case only on suspicion. Petitioner is not a family member of the deceased. She is living separately and has no concern from the deceased. She has no criminal
Patna High Court Cr.Misc. No.59812 of 2018(2) dt.05-10-2018 2/2 antecedent. She is in custody since 21.06.2018. It has been further submitted that similarly placed co-accused, namely, Shyambabu Ram, Mahendra Ram, Ram Babu Ram and Chanjoti Devi have been granted bail and anticipatory bail by co-ordinate Bench of this Court in Cr. Misc. No. 23772 of 2017 and 37255 of 2017 vide order dated 19.05.2017 and 19.08.2017 respectively.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- III, East Champaran at Motihari in connection with Turkaulia P.S. Case No. 116 of 2016.
