Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 332, 333, 147, 149 and 223 of the Indian Penal Code, registered in connection with Naubatpur P.S.Case No 71 of 2020.

The allegation against the petitioners is that they facilitated the escape of co-accused Aditya Kumar from the clutches of the police after his arrest in connection with Naubatpur P.S.Case No. 69 of 2020.

The learned counsel for the petitioners has submitted that they have been falsely implicated in this case and only

Patna High Court CR. MISC. No.9048 of 2021(2) dt.21-12-2021 2/2 allegation is that they facilitated co-accused Aditya Kumar in fleeing away from the clutches of the police by making scuffle with the police.

Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned ACJM II, Danapur, Patna in connection with Naubatpur P.S.Case No.71 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
