JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Baniyapur P.S. Case no. 19 of 2013, registered under Sections 341, 323, 324, 307 & 504/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has renewed for prayer of bail in the light of order dated 10.02.2016 passed in Criminal Miscellaneous No. 6243 of 2016, whereby the prayer of the petitioner for bail was refused with liberty to renew his prayer of bail after six months. Further submission is that petitioner is in custody since 20.02.2015 and there is no chance of the disposal of the trial of the petitioner in near future.

Having regard to the facts and the circumstances of

Patna High Court Cr.Misc. No.42414 of 2016 (2) dt.28-09-2016 2/2 the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Chapra at Saran in connection with Baniyapur P.S. Case No. 19 of 2013. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
