The petitioner is in custody since 29.06.2018 in connection with Ara Nagar P.S. Case No. 366 of 2017 for the offence registered under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that though the petitioner is not named in the first information report, name of the petitioner has surfaced on the basis of the confessional statement made before the police by one co-accused, namely, Md. Azad, who has been extended the privilege of bail by this Court. It is further submitted that the petitioner has no criminal antecedent. Considering the aforesaid facts and circumstances of the

No.59483 of 2018 (2) dt.28-09-2018 case and that the similarly situated co-accused persons have since been extended the privilege of bail vide orders dated 10.10.2017 and 17.10.2017 passed in Cr. Misc. No. 44504 of 2017 and Cr. Misc. No. 45527 of 2017, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nagar P.S.
