Having regard to the nature of allegation for offence under Sections 302/34 of the Indian Penal Code and that whatever has surfaced till now in course of investigation, on the basis of the injuries inflicted on the deceased, will at least inspire confidence in the statement of seven years old boy, the son of the deceased that while Md. Mustakim and Md. Khurshid were the main assailants but then they were assisted by these petitioners as well, this Court is not inclined to grant anticipatory bail to them. The prayer for anticipatory bail of the petitioners is hereby rejected, but then nothing said in this order, however, shall come in the way of the petitioners in surrendering and making prayer for regular bail.
