JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-03-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Jamui P.S. Case No. 341 of 2018, registered for the offences punishable under Sections 406, 420 of the Indian Penal Code. As per allegation, the accused Tiliya Devi has availed the benefit of Pradhanmantri Awas Yojana (Rural) by concealing fact. The allegation against the present petitioner is that he is sarpanch and he was instrumental in facilitating the Awas to the co-accused Tiliya Devi.
Learned counsel for the petitioner has submitted that the entire amount of Rs. 70,000/- received by co-accused Tiliya Devi has
Patna High Court CR. MISC. No.9368 of 2021(3) dt.24-03-2022 2/2 been deposited and Tiliya Devi has been granted anticipatory bail vide order dated 10.05.2019 in Cr. Misc. No. 31242 of 2019. Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioner, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 341 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. with further condition that he shall fully cooperate with the investigating authority. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
