The petitioner is apprehending his arrest in a case registered under Sections 302, 201 and 120B/34 of I.P.C. Allegation is that the accused persons murdered son of the informant, namely, Mithilesh Yadav and his friend Shivam Lal Deo by cutting neck.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due. It is a case of last seen. Two days prior to recovery of dead body of the deceased, the petitioner was seen along with the deceased. Except for this, there is no other

Patna High Court CR. MISC. No.48231 of 2019(3) dt.16-11-2019 2/2 substantive evidence to suggest his implication in this case. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest his implication in this case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Sadar P.S. case No.121 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
