The direction of this Court by the order dated 3.11.2014 under contempt was to the petitioner and one Binod Kumar Singh who had filed I.A. No. 7990 of 2014 to appear before the Circle Officer along with a certified copy of the order on 10th November, 2014 and the Circle Officer shall fix a firm
Patna High Court MJC No.4 of 2015 (6) dt.08-05-2015 2/2 date for measurement of the lands in question in presence of both the petitioner and Binod Kumar Singh and if any encroachment is found on the lands in question, take steps for its removal in accordance with law.
In the counter affidavit filed on behalf of the opposite parties Nos. 4 and 8, the District Magistrate, Patna and the Circle Officer, Patna Sadar, it is stated that the measurement was made in the presence of the petitioner and the opposite parties on 25.4.2015 and on the basis of the measurement no encroachment over public land was found. The report of the Circle Amin has also been annexed.
In the aforesaid view of the matter, the order under contempt appears to have been complied with. The contempt application is, accordingly, dismissed.
