The petitioner seeks bail in Korha P.S. Case No.272 of 2018 registered under Sections 376 and 120(B) of the Indian Penal Code as well as under Section 4 of the POCSO Act. The gist of the allegation is that the petitioner took the victim on the pretext of attending the call of nature but Rajesh Kumar Sharma and Raja Kumar Yadav took the victim at some distance and committed rape with her.

Learned counsel for the petitioner submits that the petitioner is a lady. The doctor did not find any sign of rape and the petitioner has falsely been implicated in this case. Taking into consideration the facts aforesaid and the nature of allegations made against the petitioner, petitioner, above named, is directed to be enlarged on bail on furnishing

Patna High Court Cr.Misc. No.60011 of 2018(2) dt.28-09-2018 2/2 bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J., 1stcum-Special Judge, Katihar in connection with Korha P.S. Case No.272 of 2018.
