1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2022.

3. Learned counsel for the petitioner submits that petitioner has antecedent of four cases and allegation is of recovery of 30 litres of liquor. It is next submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that the liquor was not recovered from the possession of the petitioner and he came to be implicated based on the confessional statement of Arun Paswan in police custody, which does not have any evidentiary value. It is further submitted that

4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Malsalami P.S. Case No.109/2024.
